Ex-PM Abbasi challenges 26th amendment in Sindh High Court
Former prime minister Shahid Khaqan Abbasi has filed a petition in the Sindh High Court, challenging the legality of the 26th Constitutional Amendment.
The petition calls for the amendment to be declared unconstitutional and seeks a halt to the appointment of new judges in the high courts until a decision is reached.
The petition was filed by Abbasi's attorney, Barrister Moeez Jafri, and names multiple parties, including the federal government, the Sindh government, Senate Chairman Yousaf Raza Gilani, National Assembly Speaker Sardar Ayaz Sadiq, and the Election Commission of Pakistan, as parties.
Abbasi’s plea also requests the suspension of the Judicial Commission's functioning while the petition is under consideration. The former prime minister has raised concerns about the implications of the 26th Amendment, urging the court to take immediate action to address the matter.
The 26th Constitutional Amendment has been a subject of debate, particularly regarding its impact on judicial appointments and its alignment with constitutional principles.
Justice Mansoor urges govt to address climate crisis amid administrative gaps
Senior Judge of the Supreme Court Justice Mansoor Ali Shah has stressed the urgent need for climate action and financial support to address the climate crisis in Pakistan.
Speaking at a seminar on climate change in Lahore, Justice Mansoor expressed deep concern over the lack of progress in the past seven years and called for immediate action to implement climate diplomacy and finance initiatives.
The senior judge also highlighted that despite the government's efforts in Baku, Pakistan has made little headway in combating climate change. "The last seven years have seen no tangible work on climate change," he noted.
"The courts have issued multiple directives, but the implementation on the ground remains lacking."
The senior judge emphasised that climate finance is critical to securing the future of Pakistan, framing it as a human right.
"Climate finance will be a ray of hope for Pakistan. It will provide security and climate justice to our people," he stated. "Constitutionally, we must move towards climate finance to protect human rights."
He pointed out the constitutional necessity of considering climate finance as a fundamental right, stating that climate justice is essential to safeguard the well-being of the people.
"Pakistan is the eighth most affected country globally by climate change, and we are facing a climate emergency," Justice Shah said. "The courts have always treated climate emergency cases with utmost seriousness."
Despite the urgency, Justice Shah noted that administrative hurdles have hindered progress. He referred to the 2017 law aimed at establishing a climate authority, which has yet to materialize, preventing any substantial steps toward climate finance.
"A fund was supposed to be created under the 2017 Act, but it was not mentioned in the budget. The authority has not been formed, and we are still following the truck lights,” he said, referring to the government's inability to take timely action.
Justice Masnoor Ali Shah also criticised the current lack of resources and the government's inability to focus adequately on the climate crisis. "Right now, it seems the government does not have enough money to address the issue," he noted. "A coordinated strategy for climate emergencies should be developed, but we are still not seeing that urgency."
He further highlighted that addressing climate change requires a multifaceted approach, including food security, disaster management, water security, urban planning, and agricultural reforms. "We need to integrate climate considerations into urban and agricultural planning to effectively tackle the crisis," he added.
The senior judge also noted the significant implications of the 26th Constitutional Amendment, which stripped the courts of suo motu powers, complicating the judiciary's role in climate matters.
"The 26th Constitutional Amendment has taken away our ability to act on our own in cases related to climate emergencies," Justice Shah said. "This is another issue we must address alongside climate finance."
Three-day Speakers Conference to address 18th Amendment, constitutional challenges
In an effort to tackle pressing constitutional challenges and the issue of implementing the 18th Amendment, the country's parliamentary leadership has decided to convene for a three-day Speakers Conference in Islamabad from December 18.
The conference will bring together the speaker of the National Assembly, the chairman of the Senate, and speakers from all four provinces, Azad Jammu and Kashmir, and Gilgit-Baltistan to deliberate on key national challenges.
A copy of the conference agenda, obtained by Samaa TV, reveals that the review of the implementation of the 18th Constitutional Amendment will be a primary focus.
The conference will also address several other pressing matters, including countering terrorism, combating polio, and tackling environmental challenges. Additionally, discussions will focus on bridging the constitutional gap regarding the stipulated period for the ratification of bills.
Parliamentary accountability is another significant item on the agenda. Measures will be proposed to transform parliament into a more dynamic, active, and supreme institution. This includes making the implementation of orders issued by the Public Accounts Committee (PAC) mandatory and considering the formation of an association of Public Accounts Committees to enhance oversight and governance.
Another proposal up for discussion involves the creation of an appellate forum to resolve electoral disputes. This body would consist of the speaker, deputy speaker, chairman, and deputy chairman of the National Assembly and Senate.
On the recommendation of the Sindh Assembly, the agenda also includes a proposal for equal benefits and income tax exemptions for all members of the assemblies and staff.
The conference underscores the need for collaborative decision-making to address Pakistan’s constitutional, legislative, and governance challenges. By gathering the country’s parliamentary leadership under one roof, the event aims to pave the way for more effective governance and improved implementation of constitutional mandates.

‘JUI-F only wants protection of seminaries,’ says Fazlur Rehman

Addressing an event in Nowshera, Rehman stated, “The government is connecting seminaries with terrorism. We are fighting for the protection of the seminaries. Our goal is to save religious seminaries from the government's capsize.”
“I had pointed out my reservations in front of the Pakistan Democratic Movement-led government ahead of the elections. The rulers were agreed to get the registration of the seminaries at the will of the latter [seminaries],” said Rehman.
“The bill we made through the consensus during the PDM-led government had not been passed. The negotiations were made with us in line with the 26th constitutional amendment. Subsequently, the religious seminaries’ bill was presented,” he said.

Ex-CJP Jawwad S Khawaja seeks postponement of military court appeals
Former chief justice of Pakistan (CJP) Jawwad S Khawaja has filed a petition in the Supreme Court, requesting the postponement of hearings on appeals against the nullification of trials of civilians in military courts.
The petition seeks adjournment of the hearing till a decision on the 26th Constitutional Amendment case. It argues that a decision on the 26th Constitutional Amendment is vital before proceeding with the appeals regarding military courts.
The petitioner contends that the constitutional bench of the Supreme Court was formed under the Judicial Commission, which itself came into existence as a result of the constitutional amendment. If the amendment is deemed null and void, the actions of the Judicial Commission, including the current bench, could also be invalidated.
The former CJP's petition also cites a letter from Justice Mansoor Ali Shah to emphasize the importance of resolving the constitutional issue before addressing the military court appeals.

The appeals in question pertain to the trial of civilians in military courts.
In a letter dated Dec 4, Justice Mansoor Ali Shah formally requested Chief Justice of Pakistan Yahya Afridi, who is also the chairperson of the Judicial Commission of Pakistan, to postpone the meeting of the Judicial Commission scheduled for December 6, 2024.
The meeting was to consider nominations for the appointment of additional judges to the high courts of Sindh and Peshawar.
In his letter, Justice Shah raised several constitutional concerns that necessitated the postponement. He highlighted that the legitimacy of the 26th Constitutional Amendment, which restructured the Judicial Commission, is still under challenge in the Supreme Court.
It said that over a dozen petitions against the amendment were pending, and a ruling against its validity would render any actions taken by the reconstituted commission, including the nominations/appointments of additional judges in various high courts, null and void.
Justice Shah stressed that proceeding with the appointments before the resolution of these petitions could undermine public confidence in the judiciary and waste resources.

PTI will not be banned, Imran Khan to reveal future strategy: Barrister Gohar

Speaking to journalists after meeting PTI founder Imran Khan outside Adiala Jail, Mr Gohar condemned the violence during the protests but assured that Imran Khan would soon announce the future course of action.
Addressing the media, Barrister Gohar clarified that Imran Khan had not been informed of the controversial incident on November 26, when gunfire erupted during a PTI-led protest.

He stressed that PTI remains committed to peaceful political engagement. "From whichever side the bullet was fired, we condemn it. We are a peaceful party, and our workers are enduring tough circumstances," he stated. Gauhar added that Imran Khan would provide further direction in due course.

Gohar also dismissed rumours about Imran Khan's health, asserting that the reports suggesting his deteriorating condition were false. "Alhamdulillah, he is completely fine and healthy," he said.
"I met him in jail today and briefed him on the ongoing protests and other critical issues following the final call for action made on November 24."
The claims of Imran Khan’s life being in danger in jail were recently made by PTI leader and former Deputy Speaker of the National Assembly, Qasim Khan Suri.
Suri alleged that Imran Khan had been subjected to mental distress, suggesting that the PTI founder may have been poisoned in his cell. However, Barrister Gauhar rejected these claims and reiterated that Imran Khan was in good health.
The controversy surrounding the November 26 protests, which were sparked by Imran Khan’s call for a march to Islamabad, escalated when violent clashes broke out between PTI supporters and the police.
PTI leaders, including Chief Minister of Pakhtunkhwa Ali Amin Gandapur, later presented conflicting reports regarding the casualties. While PTI officials claimed that several of their workers had died during the confrontation, Islamabad and Rawalpindi police officials countered these claims, asserting that PTI protesters had attacked police personnel with firearms, sticks, and batons, resulting in over 170 officers being injured.
Barrister Gohar expressed his sorrow over the fatalities, including both PTI workers and law enforcement officers. He revealed that Imran Khan had expressed deep regret over the loss of life and injuries sustained by his supporters and security personnel.
"Imran Khan has always advocated for peace, and these tragic events are part of the negative propaganda aimed at sowing division," Gauhar added.
The PTI leader also addressed attempts to divert attention from the protests, specifically the talks around D-Chowk and Sang Jani. He questioned whether such incidents of violence should be tolerated, using historical examples of gunfire during past political unrest.
"Would it have been acceptable if bullets had been fired in Sang Jani?" Gauhar asked. "A commission should be formed to investigate this matter, just like the Model Town tragedy."
Imran Khan, according to Barrister Gauhar, has directed that a requisition be submitted to convene a session of the National Assembly to discuss the situation. The PTI leadership continues to advocate for an impartial investigation into the violence surrounding the November protests.

Mashal Yousafzai fired after criticising PTI leadership
Mashal Yousafzai - the spokesperson for Bushra Bibi - was removed from her position as Special Assistant to Chief Minister of Khyber Pakhtunkhwa Ali Amin Gandapur.
The Chief Minister’s Secretariat issued an official notification confirming Masha’s removal, which took effect hours after her appearance on a private TV channel.
In the interview, Yousafzai revealed key details about the internal dynamics of PTI’s leadership during the recent protests in Islamabad.
In her interview, Yousafzai stated that Bushra Bibi, contrary to some party leaders' views, had opted to go to D-Chowk instead of Sangjani, despite being advised otherwise.
She recounted that Barrister Gohar had conveyed instructions from Imran Khan to Bushra Bibi, urging her to proceed with a sit-in at Sangjani. However, Bushra, expressing a lack of trust in the party leadership, decided to go to D-Chowk, a move that raised questions among party members.
She also disclosed that Bushra’s vehicle had come under fire during the protest, a claim that contradicted official police statements which had denied the use of live ammunition.
The timing of Yousafzai’s dismissal follows intense scrutiny surrounding PTI’s handling of the Islamabad protests, aimed at securing the release of Imran Khan, who has been imprisoned for over a year.
The protest's shift towards D-Chowk, in particular, has drawn sharp criticism, with many questioning the party’s strategy and the decisions of Bushra Bibi and Ali Amin Gandapur.
Mashal confirming her removal said that her dismissal was a direct consequence of her statements during the interview. "I was de-notified due to my remarks about the protest and the confusion surrounding the directions given to Bushra Bibi," she said.
The protest, which was intended to be a "do-or-die" march for the PTI leadership, had already faced internal turmoil, with key leaders like Salman Akram Raja and Sahibzada Hamid Raza resigning from their party posts in the aftermath of the failed sit-in attempt.
The spox also pointed out the confusion regarding the instructions Bushra received from her husband, Imran Khan, as conveyed through various channels.
She claimed that Bushra had expressed a desire to speak directly with Imran to confirm his intentions regarding the protest strategy, further complicating the internal dynamics of the party.
In response to her claims, the Islamabad police chief had issued a statement denying the use of live ammunition during the operation, creating a discrepancy between official reports and Yousafzai’s account of events.
According to Mashal, Bushra’s vehicle had been attacked with chemicals, forcing her to switch cars, though she was separated from Bushra amidst the chaos.

FIRs filed against Bushra Bibi in several districts after 'provocative' video
A series of cases have been registered against Bushra Bibi, wife of Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan, following a controversial video statement she made earlier this week.
The cases, filed under the Telegraph Act of 1885 and other provisions, allege that Bushra Bibi attempted to spread religious hatred and mislead the public.
The first case was registered in Dera Ghazi Khan on the complaint of a local citizen, accusing Bushra Bibi of making a provocative statement. According to the FIR, the statement in question aimed at stirring up tensions by misrepresenting political and religious issues.
RELATED: Rare video address of Imran Khan’s wife Bushra Bibi
Police have invoked Section 126 of the Telegraph Act, which pertains to the transmission of "false or defamatory" content via telegraphs or similar communication channels, along with other relevant laws.
In the controversial video, Bushra Bibi recounted an incident involving former Army Chief Qamar Javed Bajwa. She claimed that when Imran Khan visited Medina barefoot and returned, Bajwa began receiving calls questioning Imran's character, allegedly from influential figures in Saudi Arabia.
Bushra Bibi said that Bajwa was told, "Who is this person you have brought? We don’t want such people." She further stated that this led to accusations against her and her husband, with some alleging that Imran Khan was a "Jewish agent."
Following the release of the video, Bushra Bibi's statements have sparked widespread criticism, leading to additional legal actions. Separate cases were registered in Multan and Rajanpur, accusing Bushra Bibi of attempting to inflame religious sentiments among the public.
These complaints, lodged by local citizens in Qutubpur and Muhammadpur police stations respectively, echo similar accusations of religious incitement.
In response to the controversy, PTI founder Imran Khan has reportedly instructed his wife to stay away from political affairs. Sources within the party suggest that the PTI leadership, concerned about the fallout from the video statement, debated whether to proceed with the planned protest march scheduled for November 24.
After considering the Islamabad High Court's recent decision and the political turmoil caused by the statement, the PTI political committee proposed cancelling the march in favour of engaging in talks with the government.
Despite internal party discussions, a final decision on the matter was deferred after a scheduled meeting with Imran Khan at Adiala Jail failed to take place. The Khyber Pakhtunkhwa Chief Minister, Ali Amin Gandapur, later convened a meeting in Peshawar to further address the issue of the protest.
However, barrister Saif, an advisor to Gandapur, stated that the political committee was still deliberating on challenging the court’s decision and the ongoing controversy.
Nicaragua approves constitutional amendment cementing Ortega-Murillo power
President Daniel Ortega and his wife, Vice President Rosario Murillo, are poised to consolidate absolute control over Nicaragua following the National Assembly's approval of a constitutional amendment elevating Murillo to the role of "co-president."
The amendment, passed unanimously by loyalist lawmakers Friday, extends the presidential term from five to six years and grants the co-presidents sweeping authority over legislative, judicial, and electoral bodies. A second reading in January is expected to formalize the change, solidifying the pair's dominance.
Ortega, 79, and Murillo, 73, have long faced international condemnation for what critics describe as a nepotistic dictatorship. Under their rule, opposition voices have been stifled, with over 5,000 NGOs shut down and hundreds of opponents jailed since mass protests in 2018. The United Nations estimates that more than 300 people died during the unrest.
The revised constitution also labels critics as "traitors to the homeland," a designation allowing the regime to strip individuals of citizenship, a measure already applied to hundreds of dissidents.
Ortega, who first led Nicaragua from 1985 to 1990 before returning to power in 2007, proposed the constitutional changes amid mounting US and EU sanctions over human rights abuses. The amendment will define Nicaragua as a “revolutionary socialist state,” embedding the red-and-black flag of the ruling Sandinista National Liberation Front (FSLN) as a national symbol.
Critics have warned that the reform dismantles any remaining political pluralism and institutional independence. Constitutional expert Azahalea Solis described the changes as excluding alternative political ideologies, while exiled human rights lawyer Salvador Marenco labeled it the end of the separation of powers.
International reaction has been swift. Organization of American States Secretary-General Luis Almagro condemned the amendment as an “aberrant form of institutionalizing marital dictatorship” and an “aggression against the democratic rule of law.”
The Geneva-based UN Human Rights Office (OHCHR) also expressed grave concerns in its latest report, citing arbitrary arrests, torture, and increasing violence against Indigenous communities.
Manuel Orozco of the Inter-American Dialogue suggested the amendment guarantees Murillo’s succession and secures a political future for their son, Laureano Ortega. Former Ortega ally turned critic Dora Maria Tellez, now exiled in the US, summarized the move as formalizing a "de facto dictatorship."

In a video message addressing PTI workers, Bushra Bibi clarified that the PTI leadership has never encouraged violence and will continue to advocate for peaceful political expression.
“No one can be stopped from a peaceful protest,” Bushra Bibi said, asserting that PTI has always adhered to lawful means of expressing their political views. “We have never taken the law into our own hands, and we will continue to do so.”

She stated that those circulating such messages are spreading lies, stating, “The founders of PTI open the door of forgiveness when they come to power. I want to tell institutions that there will be no revenge.”
She went on to emphasise that Imran Khan’s stance is rooted in the teachings of Islam, stating that taking revenge after coming to power would be a grievous mistake and against the will of Allah. “Revenge will never be sought,” she added, noting that Imran Khan’s commitment to forgiveness is central to his political vision.
Bushra Bibi also responded to accusations that PTI has incited violence, particularly the controversial slogan of “al-Jihad al-Jihad” that has been attributed to some of its supporters.
She strongly denied any such directive from the PTI leadership, attributing these slogans to the sentiments of the people, not party instructions.
Referring to the ongoing political turmoil in the country, she remarked that while the country’s rulers are preoccupied with securing their positions, Imran Khan is dedicated to achieving “real freedom” for the people of Pakistan.
“Imran Khan is like a lotus flower in the mud of the political system,” she said, underscoring his moral and ideological stand in contrast to the current political leadership.

PML-N's defected MNA Adil Bazai disqualified by ECP
The Election Commission of Pakistan (ECP) has disqualified Adil Bazai - a former Member of National Assembly (MNA) from the Pakistan Muslim League-Nawaz (PML-N) - following a reference sent by the Speaker of the National Assembly, Sardar Ayaz Sadiq.
The ECP's decision declared the NA-262 Balochistan seat vacant, as Bazai's actions were deemed to have violated party policies and directives.
Adil Bazai, who initially joined the PML-N after being elected as an independent candidate, caused a stir during the budget session when he defied the party's instructions.
In a move that caught the attention of his colleagues and party leadership, Bazai shifted from the government benches to sit with the opposition, a clear breach of PML-N’s position.
In response to this breach, PML-N President Nawaz Sharif had sent a reference to the National Assembly Speaker, urging for action against Bazai. Subsequently,
Speaker Sardar Ayaz Sadiq forwarded the matter to the Election Commission, which took up the case and ultimately ruled in favor of disqualifying the defected MNA.
The Election Commission's ruling also highlighted that Bazai had failed to vote in favor of the 26th Amendment, further emphasizing that under prevailing laws, all parliamentarians are required to adhere to their party’s instructions.
This disqualification comes as a significant blow to Bazai’s political career, as the ECP's decision ensures the Balochistan seat will now be contested in a by-election.

"Both political and military leaderships are moving the country's matters forward. We will not allow any province's attack on the center at any cost."
Asif asserted, "Khyber Pakhtunkhwa Chief Minister Ali Amin Gandapur is holding talks with the establishment since day one."
"Anything can happen in the country's political landscape; there are still two days left before the PTI's protest," he stated.
Asif maintained, "The federal government can give the permission of staging the protest, but an attack on the center will not be allowed at all."
He said, "The lobby underway in the favor of the PTI founder. The PTI workers are indulged in the funding for the foreign lobby and harming the country."

'Years of injustices': Sharif family responds to Hassan Nawaz’s bankruptcy in UK
The Nawaz Sharif family’s spokesperson has issued a detailed response following a British court's declaration of Hassan Nawaz's company as bankrupt.
The family claims the bankruptcy is part of a series of targeted actions against their businesses.
The spokesperson highlighted that the process of bankruptcy against the Sharif family dates back to 1972 when former prime minister Zulfikar Ali Bhutto nationalized private industries. “The Sharif family was among those affected when industries were nationalized for the first time during Bhutto's era,” the spokesperson stated.
Further, the family accused subsequent regimes, including that of former president Gen (retd) Pervez Musharraf, of intensifying these challenges. “Private houses were occupied, factories were sealed, and the family endured severe oppression,” the spokesperson added.
The Sharif family also alleged that the cruelty and injustices towards their businesses continued during the tenure of former chief justice of Pakistan Saqib Nisar when the family's industrial ventures were destroyed. “The Sharif family's businesses were bankrupted four times just to teach them a lesson,” the statement claimed.
Also Read: Hassan Nawaz declared bankrupt by UK court
It added that such ups and downs, one after the other, are not new for the Sharif family.
The spokesperson said that for the sake of the country, people and principles, the Sharif family endured losses from years of hard-earned private businesses as well as personal suffering.
The statement also defended Hassan Nawaz’s bankruptcy in the UK. “During bankruptcy, companies are not required to pay taxes, a stance of Hassan Nawaz that the British court has now validated,” the spokesperson explained.
On Sunday, PML-N President Nawaz Sharif's son Hassan was officially declared bankrupt by the London High Court. The ruling came in the wake of a tax case filed against him by the UK’s tax and revenue department.
The bankruptcy declaration pertained to a specific case, which was filed in 2023. The legal proceedings were initiated on August 25, 2023, and culminated in the court's decision.
Under UK law, a bankruptcy order is a key component of the personal insolvency process. It is issued by the court, declaring an individual bankrupt. These bankruptcy orders are only published in the London Gazette once they are received from The Insolvency Service.
