Former Punjab chief minister Chaudhry Parvez Elahi has been re-arrested from outside the Islamabad Police Lines hours after the Islamabad High Court suspended his detention under the MPO and ordered his release.
Elahi was arrested by the Counter-Terrorism Department in a case registered at the CTD police station of Islamabad.
On the other hand, the Lahore High Court has ordered to produce the PTI president tomorrow.
The Islamabad deputy commissioner was issued a notice in this regard for September 12. The court also ordered to produce Elahi at the next hearing.
The high court has also barred the former CM from making any statements till the next hearing.
On Friday, the LHC had ordered that Elahi be released and issued a restraining order against his arrest by any agency or institution. However, moments after he was released, a team of the Islamabad police assisted by their counterparts in Punjab, had intercepted his vehicle near his residence.
The police personnel had shifted Elahi into another car bearing no registation number, and driven him off to Islamabad.
Elaho was detained under the MPO on the orders of the district magistrate of Islamabad. The IHC also issued a notice to the duty magistrate who ordered the detention.
Elahi’s lawyer told the court that his client has been in jail for three months, and questioned how he could disturb peace, as has been alleged by the authorities. He has not even made any statements for four months.
There is no case against Parvez Elahi in Islamabad, while he has been discharged in the case registered by the anti-corruption department, the lawyer said. Even in the NAB case his arrest has been declared illegal.
On being asked, the lawyer told the court that his client had not arranged any public gathering or resorted to mayhem in Islamabad.
Meanwhile, the Lahore High Court has ordered to produce Parvez Elahi tomorrow.
Hearing the case related to Elahi’s recovery, the court has the federal government lawyer as to why the suspect had been shifted to the Islamabad Police Lines.
It then remarked that the orders to produce Elahi had been issued already and was not a new one, and told the Islamabad High Court and chief commissioner to produce the PTI president in court tomorrow.
Punjab government’s lawyer opposed the order to produce Elahi in court tomorrow.
Earlier, the government lawyer told SAMAA TV that Elahi was not in Attock Jail, but Islamabad, as the capital police lines have been declared a sub-jail and he has been kept there.
The LHC also issued show-cause notices to the police officers who did not appear in court despite orders for the recovery of Parvez Elahi and contempt of court. The Rawalpindi CPO, Attock DPO and jail superintendent have been issued show-cause notices over contempt of court.
Justice Mirza Waqas Rauf heard the application of Parvez Elahi’s wife Qaisara. The government lawyer remarked that the single bench had restrained from arresting Elahi in any case.
Parvez Elahi has been arrested by Islamabad Police and not Punjab Police.
