Several Islamabad district judiciary judges wrote a letter to the Islamabad High Court (IHC) registrar and alleged that Justice Mohsin Akter Kiyani, being a native of Islamabad Capital Territory (ICT), is exploiting the rights of the judiciary to achieve his personal goals and crushing the others to favour his blue-eyed people.
This development came after another six judges of the IHC comprising Justice Mohsin Akhtar Kayani, Justice Tariq Mehmood Jahangiri, Justice Babar Sattar, Justice Sardar Ejaz Ishaq Khan, Justice Arbab Muhammad Tahir, and Justice Saman Rafat Imtiaz, on March wrote a letter on alleged interference in judicial affairs.
Now, the lower judiciary exposed the same judge Mohsin Akhter Kiyani for allegedly exploiting the rights of the district judiciary for his gains.
“The judges of District Judiciary Islamabad are going through an extreme state of frustration, humiliation, and sense of disowning due to atrocities extended by Mohsin Akhtar Kiyani,” the letter reads.
The judges who did not mention their names said judicial officers of the district judiciary in Islamabad except those who fully toe the line given by Justice Kayani, are being victimized.
Justice Kayani being a native of Islamabad, exploits the Distt judiciary to serve his vested interests and to maintain close nexus with notorious lawyers and litigants of the entire Islamabad.
Patronizing group of lawyers
The letter exposed that Justice Mohsin Akhter Kiyani patronized patronage of a selected group of lawyers who remained associated with him since he was a lawyer in Islamabad.
The group of advocates includes Arnanullah Kiani advocate — cousin of Justice Kiyani, Sardar Shabbir advocate, Saqib All Bhatti advocate civil judge in the district judiciary had resigned on promise by Justice Kiyani that he would be elevated to Islamabad High Court (IHC) after Justice Kiyani would take over as Chief Justice, Jan Muhammad advocate — front man and as of now this lawyer is maintaining some distance and Adil Aziz Qazi advocate.
Ethnic Discrimination
The letter by the district judiciary claiming that Justice Kayani bears against nonaligned judges was expressed through the filing of writ petition number 3408/2012 at the time when he was President of the Islamabad High Court Bar Association (HCBA).
“Through this writ petition he assailed the appointment of all the judges hailing from KP,” the letter maintained.
He vigorously pursued the said petition as a lawyer which could be verified from his attendance being marked in order sheets recorded in the writ petition referred above.
He also instigated another lawyer from the Islamabad High Court Bar Association Waqas Malik for filing Writ petition number 2294/2012 against all the judges except those hailing from the province of Punjab or Islamabad Capital Territory (ICT).
“The process of keeping the judges under stress and pressure was started by him even before his elevation as a judge of the Islamabad High Court (IHC). Justice Kayani did not stop following his evil designs even after becoming a judge of IHC,” the judges of Islamabad district judiciary alleged.
Manipulation in promotion of district judges:
“To accommodate his juniors in promotion. Justice Kayani in collusion with his puppet Tahir Mehmood Khan issued notices to judicial officers with the title "observation regarding conduct and performance,” the letter reads.
“Through such notices, he targeted all the judicial officers who were senior to his ex-chamber associate Rana Mujahid Rahim, Ghafoor Kakar, Inam Ullah, Abbas Shah, Etisham Alam Khan, and Imran Khan Sikdandari and Qudatullah.
The letter alleged that Justice Mohsin Akhter Kiyani manipulated his power and enjoyed full authority to fix judges who were not in his good books. Mr Kiyani also appointed two judges Tahir Mehmood Khan from KO and Muhammad Atta Rabbani from Punjab to exercise his control over the district judiciary and upon getting results, he appointed both in Islamabad judicial service in violation of IHC Act 2020 Section 6 (3) and Islamabad Judicial Service Rules 2011.
Extending threats
Justice Kiyani is in the habit of extending threats to judicial officers through his associates. The letter alleged that Justice Kiyani sent an open threatening message through his most trustworthy associate advocate Saqib Bhatti to those judges whom Justice Kiyani believes to be either in his rival group or aligned with any of the state institution of dire consequences whenever Justice Kiyani takes over CJ Islamabad Hich Court.
The letter claimed that judges of IHC keep almost all district judiciary officers under influence or threat in the name of the Code of Conduct while enjoying full immunity when it comes to their conduct.
