The Islamabad High Court has retrained the deputy commissioner from issuing MPO orders for an indefinite period.
Justice Babar Sattar of the IHC ruled that the Islamabad DC cannot use the powers of Section 3 MPO for an indefinite period.
This order was given during the hearing of a petition against the detention of PTI leaders Shehryar Afridi and Shandana Gulzar.
The court asked under which jurisdiction the district magistrate was issuing orders under the MPO.
It remarked that the attorney general for Pakistan would be issued a notice for only presenting the 1965 notification in this regard.
Justice Babar Sattar said assistance is required to know how the federal capital was being run.
“Have you received any notifications?” the court inquired from Islamabad DC Irfan Memon.
Whenever a DC is appointed, he is given a notification, the DC replied.
“You have still not explained how the 1960 law will be applied to Islamabad,” the court noted.
